1. Introduction
These terms govern your use of this website and any services provided by SEO Agency Adelaide ("we", "us", "our"). By using this website or engaging our services, you agree to these terms. If you engage us for ongoing work, we may also agree a written proposal or scope of work with you. If that document conflicts with these terms, the specific proposal or scope of work applies to the extent of the inconsistency.
2. Using this website
The content on this website is provided for general information only. It is not tailored advice for your business, and you should not rely on it without considering your own circumstances. We aim to keep the content accurate and current, but we do not warrant that it is complete, error-free or always available.
When using this website you agree not to:
- use it for any unlawful purpose or in a way that could damage, disable or impair it;
- attempt to gain unauthorised access to any part of the website or its systems;
- submit false, misleading or malicious information through our forms; or
- copy, scrape or republish our content except as permitted below.
This website may link to third-party websites. We are not responsible for the content, availability or privacy practices of those websites.
3. Free audits
When you request a free SEO audit, we review your website and provide general findings and recommendations, usually within one business day. The audit is provided free of charge and without obligation. It is based on the information available to us at the time and is not a complete review of every aspect of your website.
4. Our services
We provide search engine optimisation and related digital marketing services, which may include technical SEO, local SEO, content, link building, website work and reporting. The specific services, deliverables and fees for your engagement will be set out in a proposal or scope of work that we agree with you.
We will perform services with due care and skill, using white-hat methods consistent with search engine guidelines. We may use team members across the globe, in Asia, the US and Australia, as well as trusted third-party tools, to deliver the work.
5. Term and cancellation
Unless we agree otherwise in writing, ongoing services are provided on a month-to-month basis with no lock-in contract. Either party may end the engagement by giving written notice before the start of the next monthly billing period. Fees already paid for the current month are not refundable except where required by law, and work for that month will continue to the end of the period unless we agree otherwise.
When an engagement ends, we will hand back any access you have given us and provide the deliverables you have paid for.
6. No guaranteed results
Search rankings are controlled by search engines, not by us.
Search engines change their algorithms frequently and without notice, and rankings are affected by many factors outside our control, including competitor activity, changes to your website made by others, and the history of your domain. For these reasons we do not guarantee any particular ranking, traffic level, number of enquiries or revenue outcome.
Any examples of past results on this website relate to specific clients in specific markets. Individual results vary. Past performance is not a guarantee of future results.
7. Your responsibilities
To help us deliver the services, you agree to:
- provide accurate information and timely access to your website, analytics and other accounts as reasonably needed;
- review and approve content and changes within a reasonable time;
- ensure that any material you supply to us, such as images, text or logos, does not infringe anyone else's rights; and
- ensure your business claims and advertising are accurate and comply with any laws or professional rules that apply to your industry.
Delays in providing access, information or approvals may affect timelines and outcomes.
8. Fees and payment
Fees are set out in your proposal or scope of work and are payable in advance for each monthly period unless we agree otherwise. Prices are in Australian dollars. We may pause work on an account with overdue invoices after giving you notice. Any change to our fees will be notified to you in writing before it takes effect, and you may end the engagement if you do not accept the change.
9. Intellectual property
All content on this website, including text, design, graphics and code, is owned by us or our licensors and is protected by Australian and international copyright laws. You may view and print pages for your own personal, non-commercial use, but you may not otherwise reproduce or republish them without our written permission.
For client work, once you have paid the relevant fees in full, you own the content and website deliverables we create specifically for you. We retain ownership of our pre-existing materials, methods, templates, tools and know-how, and we grant you a licence to use any of these that form part of your deliverables. Third-party materials, such as stock images or software, remain subject to their own licence terms.
10. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other legislation that cannot lawfully be excluded or limited. This includes the consumer guarantees that services will be provided with due care and skill and be reasonably fit for any purpose you make known to us.
Where the law allows us to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.
11. Limitation of liability
To the maximum extent permitted by law, and subject to section 10:
- we are not liable for any indirect or consequential loss, or for any loss of profit, revenue, data, goodwill or business opportunity, arising from your use of this website or our services;
- we are not liable for any loss caused by search engine algorithm changes, third-party platforms or tools, or changes made to your website by anyone other than us; and
- our total liability to you in connection with our services is limited to the fees you paid us for the services in the three months before the event giving rise to the claim.
Nothing in this section limits liability that cannot be limited by law.
12. Governing law and changes
These terms are governed by the laws of South Australia, Australia. You and we submit to the non-exclusive jurisdiction of the courts of South Australia and any courts that may hear appeals from them.
We may update these terms from time to time. The current version will always be published on this page with the date it was last updated. For ongoing clients, we will let you know of any material change before it applies to your engagement.
Questions about these terms can be sent to us through the form on our contact page. You can also read how we handle personal information in our privacy policy.
